Samsung prevails in Japan

A Japanese court on Friday rejected Apple's claim that Samsung stole its technology, dealing a blow to the iPhone maker after last week winning $1.05-billion in damages in the US from its bitter rival.

The ruling by the Tokyo District Court is the latest chapter in a long-running global patent war between the smartphone giants who have accused each other of stealing intellectual property for their own products.

The Japanese court found that Samsung did not infringe on Apple's iPhone and iPad patents for some of its own Galaxy smartphones and tablet computer. The three-judge panel also awarded legal costs to Samsung.

"The defendant's products do not seem like they used the same technology as the plaintiff's products so we turn down the complaints made by (Apple)," Judge Tamotsu Shoji told the court.

Apple had sought damages and the block of sales of its some of Samsung's products in the lucrative Japanese market.

But as well as dealing a blow to the US firm, the ruling will help Samsung pick itself up after the defeat in the United States, analysts said.

Samsung shares closed 1.48 percent higher in Seoul on Friday.

"Investors were encouraged by the ruling in Tokyo... it eased concern over Samsung's future which had been raised by the defeat in the US court battle," said Seo Won-Seok, analyst at Korea Investment Securities.

Samsung, which has steadfastly denied its rival's claims in a string of similar cases filed across the globe, hailed the Tokyo court's ruling.

"We welcome the court's decision, which confirmed our long-held position that our products do not infringe Apple's intellectual property," it said in a statement.

A Japan-based spokesperson for Apple, which can appeal the verdict, declined to comment.

Last week the iPhone maker won $1.05 billion in a massive US court victory over Samsung with jurors finding that the South Korean firm had "willfully" infringed on Apple's patents.

The Japanese case, which focused on Apple's claim that Samsung stole technology used to transfer music and video files, sought a comparatively small amount - 100 million yen ($1.27-million) - in damages.

Both firms' gadgets are increasingly popular in the the Japanese market which was previously monopolised by domestic giants such as Sony and Sharp.

"It was a ruling on just one technology so it is difficult to draw any conclusion on its overall impact," said Michiru Takahashi, a patent lawyer at Jones Day in Tokyo.

"But... if Samsung had lost again it would have considerably hurt its image."

The high-profile verdict in the United States last week regarded patents on a range of Samsung products including some of its popular smartphones and its Galaxy 10.1 tablet.

Jurors rejected the South Korean electronics firm's patent theft counterclaims against Apple.

Also last week, a court in Seoul ruled the pair had swiped each other's technology and awarded damages to both sides.

The Seoul Central District Court said Apple breached two of Samsung's technology patents, and ordered it to pay 40 million won ($35 000) in damages.

It also ordered Samsung to pay 25 million won for violating one of Apple's patents. Each company had sought damages of 100 million won from the other.

The South Korean court said there was "no possibility" that consumers would confuse Samsung and Apple smartphones - a key issue in the US trial - and that Samsung's smartphone icons do not infringe Apple's patents.

But it said Samsung infringed Apple's patent for bounce-back technology, a widely copied spring-back action when users reach the edge of a document.

The court imposed a partial ban on both firms' product sales.

The patent cases come as Apple loses ground to rivals including Samsung that use the Android operating system developed by Google.

Samsung shipped 50.2 million smartphones globally between April and June, while Apple sold 26 million iPhones, according to research firm IDC.

The Asian firm held 32.6 percent of the market compared to 16.9 percent for Apple, while the US company holds about a 70 percent market share for tablets.

New car standards good for air, reduced oil dependence

The Obama Administration this week finalized new fuel efficiency standards leading to cars and light duty trucks that achieve 54.4 miles per gallon by 2025.

There is much to like about the fuel efficiency standards, which have the support of the 13 major automakers responsible for 90 percent of the vehicles sold in the United States.

Energy efficient vehicles move this country away from dependence on foreign oil. The fuel efficiency programs already in place and improving over the next decade will reduce oil consumption by more than 2 million barrels a day by 2025. That?s the equivalent of about half of the oil we import from OPEC each day.

It?s abundantly clear that oil is a finite resource, but a resource the global economy still leans on heavily. Anything the government and auto industry can do to significantly reduce consumption helps to stretch those supplies out while innovators work on new technologies to transition from the fossil fuel economy.

The fuel efficiency standards also represent one of the few success stories in the bid to reduce carbon pollution that contributes to climate change. The standards should cut emissions from cars and small trucks by 50 percent by 2025. It represents a carbon dioxide emission reduction of 6 billion metric tons over the life of the program. Put another way, the CO2 reductions are more than all of the carbon dioxide emitted by the United States in 2010.

With gas prices once again above the $4 per gallon mark this summer, consumers know just how big of bite fuel for vehicles takes out of a household budget. Federal officials estimate that a family buying a 2025 model car will see a fuel savings of about $8,000 over the life of the vehicle. That?s comparable to lowering the price of gas by about $1.

Consumers are already gravitating to energy efficient vehicles entering the market place. There are gas-powered cars on the market achieving 40 mpg on the freeway without compromising comfort, safety and acceleration. There?s ample reason to believe that the auto industry can and will take advantage of a variety of new technologies as it transitions to the cars of the future.

Some of the technologies already available include: advanced gasoline engines and transmissions, vehicle weight reductions, lower tire rolling resistance, improved aerodynamics and improvements in air conditioning systems.

The federal fuel efficiency program also provides incentives for electric vehicles, plug-in hybrid electric vehicles and vehicles that utilize fuel cells.

The fuel efficiency standards provide an opportunity for America to lead the way to a new transportation future that other nations can and should emulate.

In case you haven't noticed, there are two kinds of Windows 8 devices on display at IFA this week: laptop / tablet hybrids, and already-announced laptops, refreshed to include touchscreens. Acer's newest two Ultrabooks fall into that second category: the company just announced touch-enabled versions of its Aspire M3 Ultrabook and Aspire V5 thin-and-light. For now, Acer isn't saying a word about price or availability, so for now you'll have to be content with a few spec details, all embedded after the break.

Too much protein HUWE1 causes intellectual disability

ScienceDaily (Aug. 30, 2012) ? Two to three percent of children are born with an intellectual disability. Possibly by a genetic defect, but in 80 percent of these cases, we do not know -- yet -- which genes are responsible. VIB researchers at KU Leuven show that increased production of the HUWE1 protein is the cause in some patients.

"The fact that HUWE1 regulates the dose of several other proteins in the brains, has an important impact on the quest for new therapies. It would then be possible to intervene in these different proteins. Research into the role of HUWE1 has already started in the lab."

Defects on the X-chromosome

Intellectual disability can be due to external factors such as lack of oxygen at birth or to defects in the genetic material. In genetic (hereditary) causes, the exact identification of the defect is crucial for the medical supervision of the patient or to estimate the risk when having children. It is estimated that approximately 15% of patients have a defect that lies on the X-chromosome. This is called X-linked 'intellectual disability' (XLID). Despite extensive research, in half of XLID-patients, the responsible gene responsible has not yet been identified.

HUWE1 identified as culprit

Guy Froyen and his colleagues (VIB -- KU Leuven) continue their research to find new genes that may cause XLID. Several years ago, they showed that the duplication of a fragment of the X-chromosome leads to a too high concentration of HSD17B10 and HUWE1 proteins.

Guy Froyen: "We knew then that these two proteins could play an important role in the (development of) the memory center in the brains, but we did not yet know which gene was the cause for the increased dose of XLID. Through additional research, including the DNA of 6 additional families from Europe, Australia and South Africa, we now know that HUWE1 is the crucial factor, and that a concentration increase of HUWE1 leads to intellectual disability. "

Consequences for detecting and treating XLMR

The research by Guy Froyen and his colleagues offers new perspectives for the detection and treatment of XLID. This allows for tests to be designed with which the duplication of and errors in HUWE1 are searched. For the development of a new treatment for XLID, further research is required. First of all, scientists must better understand the role of HUWE1 in the body, more specifically in the brains.

US consumer spending rose 0.4 percent in July

WASHINGTON (AP) ? Americans spent at the fastest pace in five months in July after earning a little more. The increase in income and consumer spending could help boost an economy mired in subpar growth.

Consumer spending rose 0.4 percent in July from June, the Commerce Department said Thursday. That followed no change in June and a slight decline in May.

Income grew 0.3 percent, matching the gains from May and June. Americans also earned 0.3 percent more after paying taxes.

Paul Dales, senior U.S. economist at Capital Economics, said that the rise in spending showed "there is still life in American consumers." But he cautioned that higher gasoline prices and a decline in consumer confidence in August could dampen spending in coming months.

The savings rate after taxes dipped to 4.2 percent. That's down slightly from 4.3 percent in June, a level which had been the highest in a year. Economists believe Americans began saving more in part because of concerns triggered by a sharp slowdown in job growth earlier this year.

Hiring picked up in July and could see further gains in August. The number of Americans seeking unemployment benefits was unchanged last week at a seasonally adjusted 374,000, the Labor Department said in a separate report Thursday.

Applications are a measure of the pace of layoffs. They have risen slightly over the past three weeks but remain lower than they were in the spring, when hiring nearly stalled. When applications fall consistently below 375,000, it generally suggests that hiring is strong enough to lower the unemployment rate.

That raises hopes for a solid gain when the government releases its August jobs report next Friday.

Consumer spending is closely watched because it accounts for 70 percent of economic activity. The economy grew at a tepid annual rate of 1.7 percent in the April-June quarter, the government said Wednesday.

Many economists expect growth will hover around 2 percent in the second half of the year. Growth at that level is far below what is needed to rapidly lower the unemployment rate, which ticked up to 8.3 percent in July.

Slow growth could prompt the Federal Reserve to take further steps to boost the economy when policymakers meet again on Sept. 12-13. In late July, Fed policymakers spoke with increased urgency about the need to provide more help for a weak U.S. economy.

Chairman Ben Bernanke could offer some clues Friday to what the Fed might announce when he speaks at a Fed conference in Jackson Hole, Wyo. Some suspect the Fed will wait to see how the economy performed in August, especially after July's data was better than expected.

Inflation has been tame, which could provide the Fed more leeway to act.

Consumers paid no more their purchases in July than June, the report showed. Excluding food and energy, prices over the past year are up just 1.6 percent, well below the Federal Reserve's 2 percent target for inflation.

Employers created 163,000 jobs in July, the most since February. Consumers stepped up retail spending, factories produced more goods and the housing recovery continued with increases in both new and previously occupied homes.

In its latest survey of business conditions around the country, the Federal Reserve reported Wednesday that the U.S. economy grew moderately in July and early August with stronger retail sales helping to offset weakness in manufacturing.
